Based on the filings it appears the new board (Zongfu, Jake, Lee Lin and Arlene) want to keep the Bankruptcy going and want the HOA to borrow $250,000 from Zongfu to pay the lawyers so they keep working for them.  Court has some questions as per the court minutes.

FYI information…

 

The Board voted last week to approve Zongfu loaning the HOA $250,000 to pay administrative fees (legal fees).   This is for legal fees only, not to fix the roof, address the open security concerns, clean up the place, etc.  Mr. Carmel informed the court all homeowners present at the meeting agreed with the loan motion.  It is our belief there were no homeowners at the meeting besides the board members and a # of attorneys.  It is our belief the HOA never provided specific notice (agenda) to the homeowners they were meeting to discuss Zongfu loaning the HOA $250,000 to pay the lawyers.  CRP filed the attached objection with the court.

 

In addition, the HOA Board requested the new HOA attorney file an objection responding to my request to move Legal Case #1 back to state court so that we could keep moving the process along.  Zongfu and Jake numerous times have told everyone it was not costing the HOA a dime.  The objection filed by the HOA (Zongfu and Board) asks the judge not to move the case back to state court.  For the record I never requested case #1 be put on hold.  That was done I believe at the recommendation of the HOA attorneys working with the other board members in the BK process.  At the same time CRP’s case #3 against the Board Members (Zongfu, Jake, etc) was also suspended due to the BK process.

 

There is new information that the Board is going to request that Case #1 be transferred back to the HOA specifically, so it once again becomes an HOA expense which is how the HOA ran out of funds the first time.

April Business Report

Homeowners:

 

Mr. Carmel has filed the April Business Report with the court.  Here is the OPERATING Bank Statement with ending balance of $4403.87 on April 30th, 2023.

Financials have been requested from Mr. Gross numerous times but no response.  The portal as of this evening still shows NO financials to report.  Mr. Gross started providing services on November 1st, 2023.
