Received your communication.  Understand you (the Trustee) are working with the Board to secure financing ($250,000) to pay open legal fees.  These funds will be used only to pay legal fees and not address any of the open needs of the community IF I understand the request.  We are happy to participate in the conversation.  Without understanding the goal, it is difficult to provide terms.  We understand the Board has terminated the Debtors legal counsel (Guidant) and the Board is hiring a new firm to prepare a new BK plan.  Assume additional funds will be required for this firm as well.

 

Are you seeking to facilitate a loan before the new plan is even proposed?  How does the Board envision the loan will be secured?  What funds will be used to pay back the loan?  Is this a short-term loan or a long-term loan?

 

Assume there will be an open Board meeting about this topic (financing/loan) and we are happy to participate.

I am working with the new Board on obtaining financing to cover all court-approved administrative fees and costs.  In the past Mr. Gordon has indicated a willingness to provide such financing.  The current approved and unpaid fees total $167,138.86.  Additionally, Guidant filed an application for $68,923.05, and there are accruing fees for the Trustee and special counsel.  The approximate amount of the loan will be $250,000.00.  Please discuss with Mr. Gordon whether he is willing to make a loan to the debtor, and if yes, what are the terms.  I intend to file a Motion within the next couple days, so appreciate quick response.

  1. Man with gun threatening residents
  2. Tenant's vehicle was stolen from parking lot
  3. Pool fence (not gate) broken allowing unlimited access to the pool.
  4. Potential liability in pool area with no supervision.

 

Understand crime rate and police on-site requests are rather high for Mesa Terrace so far in 2023.  Requesting 2021, 2022 and 2023 YTD Lexis Nexus reports.

 

Understand Maricopa County is communicating with Transcend already relating to the pool fence issue.

Thank you for the note.

 

A meeting about improving the property is an open meeting.  This is a closed meeting without an agenda that was scheduled right after an HOA requested deposition.  Prior to this scheduled meeting the HOA is incurring legal fees to depose Mark Butterfield. 

 

While I agree with your philosophy in theory the big picture is still not being addressed.  Maybe you have heard from the new Board privately, but I am not aware of any communications that have been sent out from the HOA informing the Homeowners of the objections, the current board, their next steps, etc.  I too am hopeful they will take care of the property this go around but again I stress without the parties working together this will never be achieved.

 

Have you seen any financials?  Transcend started in November 2022.  Understand there are record issues from APM which the previous Board had already communicated as well but they should be able to provide expense records from November 2022 through April.

 

NOTE: The 48-hour notice comment was just for reference to specific parties and the attorneys relating to all Boards should be treated the same way.

Let's give them a break Scott. They are trying to hold a meeting to discuss how to improve the property and get things back on track. What else would they be holding a meeting for? Let's not worry about the 48 hour notice so they can work as efficiently as possible. We really all need to give each other some grace without a constant public notation of what they are doing wrong. Let them work to get our community back in order and let's give them the benefit of the doubt that our new board will operate better than they did last time they were in there. Let's watch the financials monthly and make sure they are fiscally responsible. Let's watch the property to see improvements and proper maintenance. It won't take long for them to show that they are a good board. Let the fruits show their intent. Now that we are all paying crazy high HOA dues, they should be able to manage the property and improve our investments rapidly.

Mesa Terrace Pool Inspection - 1224 E Evergreen Street Mesa AZ 85203

Homeowners:

 

Here is a copy of the Maricopa County Pool Inspection report from 5/1/23 for reference.  Maricopa County has closed the pool.

 

Per notes the water is not being maintained among other things.

 

Observed water disinfectant residual (free chlorine) out of acceptable range at 0.0 ppm. Pool posted closed and suspension notice issued.

Please maintain a free chlorine residual of 1.0 to 5.0 PPM in pool.

Mr. Gordon,

All HOA's can act in the best interest of the HOA to provide for the Health and Safety of the community.  If there is a water leak that is ongoing and the parties do not resolve it, the HOA can issue a 48-hour notice by mail to the owner and by posting on the tenant's front door a notice informing them of the pending action. 

 

If the parties do not comply with the request for entry, under the law and with proper notification the door lock can be forced in order to gain access to the unit and make repairs to whatever may be causing damage to the component parts of the building.

 

This is rare but is allowed and many condominiums have used this in the past to make repairs when owners cannot or will not coordinate with each other to make repairs.  It is an expensive proposition for the owners, so I always suggest that the parties work together to stop active leaks and make repairs quickly. 

 

You should make every effort to allow access to the unit, including informing the other owner of a wide range of days of times when someone will be available.

Just so we (CRP) understand your communication and the HOA's process.

 

The HOA has the authority to provide 48 hours notice to the TENANT and if access is not granted the HOA will force entry into the unit and the HOA will back bill all fees incurred.  Are we understanding this correctly?  How exactly will notice be provided?  Will the Homeowner be provided notice as well?

 

CRP has been attempting to coordinate access for almost 2 weeks now.  This must be coordinated with reasonable notice, not someone just showing up at the door and assuming someone is waiting to provide access.

Mr. Zongfu Li,

Please attempt to contact Mr. Gordon or his staff about accessing unit 134 again.  He appears to be ready to assist your team in gaining access to the unit so that repairs can be made.  We are requesting that this issue be resolved immediately and without delay.

 

Mr. Gordon,

Please be flexible and let you tenant know that Mr. Li's team will need full, unfettered, and immediate access to the unit to conduct repairs. 

 

All,

Failure to allow access in a timely manner may result in issuance of a 48-hour notice demanding your tenant allow access to the unit during business hours so that the repairs may be completed.  Failure by either party to make repairs may result in the HOA conducting repairs and billing the responsible party(s).  If forced access is required, then there may be additional charges for legal expenses and the expense to force the locks and replace any damage locks which can be caused when having to force open the unit.

 

All parties have been duly informed of their responsibilities in this situation.  Please note, we will expect that the parties will have worked together to have repairs completed by Thursday, May 4th, 2023.  Please inform us when the work is completed.
