Kirsten is the owner of Transcend Community Management Company. This is the firm that "manages" Mesa Terrace Condo Assoc. There is no harassment sending her an email about an on-going issue and lack of response from her firm. She can choose to ignore. We are not aware of any law that prevents us from posting/sharing our experience with Transcend Community Management. If you have a legal claim, make it.
In regard to the leak you should re-visit the thread. Zongfu's vendor did NOT show up on the date/time we had all agreed to. We provided access another time when he just showed up and then he never came back that date. He was denied access another time that we had no knowledge that he was coming and made no arrangements.
Since that time communications to Transcend and Zongfu have gone un-answered.
Quite possibly you know something we do not know but based on previous legal documents, insurance processes and the CCRs the HOA is responsible for the common elements including the area between the 2 units and maintains the insurance and thus is responsible for the damages. I understand you may not agree but until we receive a legal opinion that offsets previous legal opinions we will continue on this path.
CRP has notified the Homeowner and Transcend.
At the end of the day we have the President of the HOA and Transcend that are on notice about the water leak. The simple answer would be to get it fixed and work together but unfortunately there is always a confrontation that requires legal escalation. This will be at least leak #5 where Zongfu did not respond in a timely matter. Do not take my word for it, ask HOA Attorney Scott Potter.

You have been instructed to cease all communication with Kirsten Shafer. Continued communication with her in any form is considered harassment which may be sexual harassment and/or harassment with the intent to do mental or physical harm.
Harassment is defined as offensive, unwelcome conduct based on a victim's protected characteristic, that is so severe or pervasive that it affects the victim's since of safety.
Continued communication of any nature is considered harassment, and you are instructed to immediately follow our protocols of how to contact our company. 135/234 LEAK COMPLAINT
Regarding your inquiry of unit 234 leaking into unit 134, it was previously communicated to you that it is an Owner-to-Owner issue, and you should contact Mr. Zongfu Li directly. You already have the contact information for Mr. Zongfu Li.
Should you be unable to resolve your issues with Mr. Li then you have recourse. Using the HOA and/or management as your de facto negotiating tool is not acceptable. If you find that Mr. Li is unresponsive you may request our assistance. However, if we choose to assist it in no ways means that the HOA nor management accept any responsibility for resolution of the matter. Additionally, If you feel all resources have been exhausted you may request an audience with the board to see if you may find some solution there.
A review of the email string below shows that Mr. Li has been communicating with you and attempted to send service people out to resolve the problem but were denied entry. It is incumbent upon you to make access to the unit easily available to all who are trying to assist in the repairs. Setting up restrictive conditions for entry will only further delay your problems. Also, might is suggest that you stop using your emails to the entire community through the Board Owned Gaggle account to impugn the reputation of your fellow HOA members. It is neither neighborly nor in good taste.
You have now been responded to multiple times on this issue. We recommend you work this out with Mr. Li prior to further reporting. We are here to help if you follow the proper reporting and communication protocols.

Homeowners:
This communication is meant for documentation purposes. Zongfu, along with Transcend Community Management and Scott Potter (HOA Counsel) have been notified about a water leak since Monday. CRP has not received any response from Transcend Community Management or Scott Potter on this matter.
Zongfu did respond the other day setting an appointment for 1P. Access was made available, and vendor never showed. Instead, vendor showed at 5PM, stated he was going to 2nd floor unit to run some tests and never returned.
CRP continues to ask to coordinate a time versus just showing up unannounced so all parties can work together and minimize further damages and expenses.

Again 2 sides to the story.
This issue was reported to you on Monday.
Your vendor did not come at 1P on Tuesday as was agreed to.
Your vendor came around 5P, spoke to the tenant and left it at he was going upstairs to run the shower. After 30 mins we heard nothing back from your vendor which is when I emailed yesterday.
So to be clear your vendor wants to come out again at 1PM on Thursday to do what? We already provided the video to you to show where the water is coming from (out the ceiling fan in bathroom).

My plumbing guy said he talked to your tenant yesterday afternoon, your tenant didn't want him to be in to see what the leak was, but scheduled 1pm tomorrow (Thursday) to come back to see what the problem is. Also we will have tenant at 234 available tomorrow afternoon.

I have confirmed CRP will provide access between 1P and 1:30P. At 1:30P access will no longer be available, but we can reschedule for another time if needed.
NOTE: At this moment it is not leaking. All water has come through the fan cover to date. Plumber is welcome to look in 134 but we are opening the ceiling if applicable until we have an agreement on how the drywall/paint is being repaired.
Please advise findings.
