March 2023 Operating Report

Homeowners:

 

For those of you who are not following the court filings (since HOA is not sharing with the Homeowners), Michael Carmel filed the March 2023 operating paperwork with the court.  Despite repeated requests for financials for whatever reason Transcend Community Management and Carmel are not willing to share them and are only submitting paperwork to the court.

 

Carmel reported that the HOA brought  in $25,875.00 in cash in March and spent $25,561.95, NET profile per say of $313.05

 

What is interesting, IF each homeowner paid their share of HOA dues that is roughly $16,000 for the month, yet the HOA took in $10,000 more (almost $26,000)?  Prepaid dues?  Accounting mistakes?

 

The expenses do not include legal fees to our knowledge which are submitted to the court separately and does not include the $40,000 Zongfu paid so Michael Carmel could get paid.

 

Regardless the HOA spent pretty much every penny it brought in….

The document you included doesn't provide the details needed to do online voting and there are numerous homeowners who do not wish to vote online but rather with the standard written ballot you as a Homeowner and past Board member have provided/participated in for years.

This is highly unusual.  In a typical election, there is 1 ballot that encompasses everything. Even if there are several ways to cast your ballot, all of the ballots achieve the same result and have the same options. I don't think it is appropriate to cherry pick the votes and use old votes, have several different ballots, some to do electronically with an account number and voting code buried somewhere in an email, some on paper, but no place to do write ins, and a half hour only if you want to do an electronic write in.  So far, this does not seem like a fair and unbiased election. No matter how you spin it, it is not a clearly transparent election. 

 

Again, I ask, why are you doing it this way?  It is not logical in any sense of the word.  The management company should have a very clear understanding of how to run an election and I just don't see that it is being conducted in any sort of professional manner.  How many lawyers and how many hours have we spent on this sham of an election? Unless someone is trying to rig an election, it should be conducted properly.  

 

Seriously, you know that this isn't proper decorum.

The notice that you received with the new ballot answers all of your questions.  I have attached a copy of the notice in the event you discarded it.  Please review the notice. 

 

Specifically, the notice informs you that if you want your vote to count which was cast prior to the April 6 meeting, you don't have to do anything.  If you wish to change your vote, you can either 1) mail in or email in a new ballot prior to the April 24 meeting, or 2) vote live during the April 24 meeting using the online voting system (in such event you will need the account number and voting code supplied with your new ballot).  If you chose to vote using the live system, a write-in option will be available. Since we are now subject to voter suppression and an incredibly complicated and unexplainable voting method, I don't know how to vote. I received some emails to vote online and some ballots by mail. Are my previously online votes going to count? How will you decide which votes to use? Why not have just sent out normal ballots like every other HOA and do a normal election with write ins available on paper? This is incredibly confusing and convoluted. Shouldn't have to be so complicated. This is definitely how you make it so exhausting that people just throw their hands up in the air and do nothing.  The big question is, WHY would you do that?

Homeowners:

 

Zongfu and Jake have communicated their reasons for starting the case as Board Members and then maintaining legal case #1 at their cost.  Multiple communications have been sent asking if they would stipulate to continue the process at their cost in State Court so we could move the case along. 

 

As you are aware they have not replied.

 

CNA Insurance (HOA's insurance company) this week engaged a Bankruptcy attorney to go through the process of moving the case to state court.  The interesting part will be to see if the Zongfu group agrees or further attempts to delay the legal process AND if they will continue to pay for it out of their pocket.

The assumption is you are not willing to stipulate yet you keep referencing CRP is trying to stop the litigation. 

 

At this point CNA Insurance is working through the onboarding process of a law firm that is experienced in the bankruptcy court process to move this process along, specifically to move this back to state court so we can proceed. 

 

If there is any interest on continuing the conversation Michael Carmel started with us please reach out.  It is in the communities best interest to do this before Tuesday afternoon.

This communication is meant for documentation purposes.  Zongfu, along with Transcend Community Management and Scott Potter (HOA Counsel) have been notified about a water leak since Monday.  CRP has not received any response from Transcend Community Management or Scott Potter on this matter.

 

Zongfu did respond the other day setting an appointment for 1P.  Access was made available, and vendor never showed.  Instead, vendor showed at 5PM, stated he was going to 2nd floor unit to run some tests and never returned.

 

CRP continues to ask to coordinate a time versus just showing up unannounced so all parties can work together and minimize further damages and expenses.

Again 2 sides to the story.

 

This issue was reported to you on Monday.

 

Your vendor did not come at 1P on Tuesday as was agreed to.

 

Your vendor came around 5P, spoke to the tenant and left it at he was going upstairs to run the shower.  After 30 mins we heard nothing back from your vendor which is when I emailed yesterday.

 

So to be clear your vendor wants to come out again at 1PM on Thursday to do what?  We already provided the video to you to show where the water is coming from (out the ceiling fan in bathroom).

My plumbing guy said he talked to your tenant yesterday afternoon, your tenant didn't want him to be in to see what the leak was, but scheduled 1pm tomorrow (Thursday) to come back to see what the problem is. Also we will have tenant at 234 available tomorrow afternoon.

I have confirmed CRP will provide access between 1P and 1:30P.  At 1:30P access will no longer be available, but we can reschedule for another time if needed.

 

NOTE: At this moment it is not leaking.  All water has come through the fan cover to date.  Plumber is welcome to look in 134 but we are opening the ceiling if applicable until we have an agreement on how the drywall/paint is being repaired.

 

Please advise findings.

I don't think it is appropriate to cherry pick the votes and use old votes, have several different ballots, some to do electronically with an account number and voting code buried somewhere in an email, some on paper, but no place to do write ins, and a half hour only if you want to do an electronic write in.  So far, this does not seem like a fair and unbiased election. No matter how you spin it, it is not a clearly transparent election. 

 

Again, I ask, why are you doing it this way?  It is not logical in any sense of the word.  The management company should have a very clear understanding of how to run an election and I just don't see that it is being conducted in any sort of professional manner.  How many lawyers and how many hours have we spent on this sham of an election? Unless someone is trying to rig an election, it should be conducted properly.  

 

Seriously, you know that this isn't proper decorum.

The notice that you received with the new ballot answers all of your questions.  I have attached a copy of the notice in the event you discarded it.  Please review the notice. 

 

Specifically, the notice informs you that if you want your vote to count which was cast prior to the April 6 meeting, you don't have to do anything.  If you wish to change your vote, you can either 1) mail in or email in a new ballot prior to the April 24 meeting, or 2) vote live during the April 24 meeting using the online voting system (in such event you will need the account number and voting code supplied with your new ballot).  If you chose to vote using the live system, a write-in option will be available. Directions on how to send your vote and deadlines for casting a vote by mail or email are in the notice and are clearly explained.

Since we are now subject to voter suppression and an incredibly complicated and unexplainable voting method, I don't know how to vote. I received some emails to vote online and some ballots by mail. Are my previously online votes going to count? How will you decide which votes to use? Why not have just sent out normal ballots like every other HOA and do a normal election with write ins available on paper? This is incredibly confusing and convoluted. Shouldn't have to be so complicated. This is definitely how you make it so exhausting that people just throw their hands up in the air and do nothing.  The big question is, WHY would you do that?
